1. General Information
1.1. These Terms and Conditions define the rules of using the online store available at: gemstonika.shop.

2. Electronic Services
2.1. The Store provides the following electronic services:

• enabling placing orders,
• maintaining a customer account (on demand),
• newsletter subscription.

2.2. Technical requirements necessary to use the Store:

• device with internet access,
• web browser (e.g., Chrome, Safari, Firefox),
• active email account.

2.3. The Customer is prohibited from providing unlawful content.

3. Products
3.1. All products offered in the Store are handmade, custom, or limited edition items.
3.2. Product photos are real, however slight differences may occur due to the nature of handcrafted production and metal casting.
3.3. All prices are listed in EURO and include VAT.

4. Orders and Conclusion of the Contract
4.1. Placing and paying for an order constitutes an offer to conclude a sales contract.
4.2. The order processing time is calculated from the moment the payment receives positive authorization. Order processing time takes up to two business days.
4.3. The Seller reserves the right to refuse or cancel an order in case of suspected fraud or incorrect data.

5. Payment Methods

The entity providing online payment services is Autopay S.A.
5.1. In the case of refunds for card payments, the Seller will return the funds to the bank account assigned to the Customer’s card.

6. Shipping and Delivery
6.1. Delivery methods: Polish Postal Service or Inpost (Poland only).
6.2. Delivery costs: 9 or 3 euro respectfully.
6.3. Estimated delivery time: see Delivery.
6.4. The Seller is not responsible for delays caused by incorrect shipping data or customs procedures.
6.5. International shipping may be subject to customs duties and restrictions.

7. Right of Withdrawal
7.1. The Customer has the right to withdraw from the contract within 14 days of receiving the product, without giving any reason.
7.2. To exercise the right of withdrawal, the Customer must inform the Seller via email: gemstonika@gmail.com.
7.3. The Seller refunds payments using the same payment method used by the Customer, unless otherwise agreed.
7.4. The right of withdrawal does not apply to:

• custom-made or personalized products,
• products made to individual order.

8. Complaints and Warranty
8.1. The Seller is obliged to deliver goods free from defects.
8.2. Complaints can be submitted via email: gemstonika@gmail.com.
8.3. The complaint should include:

• customer details,
• description of the defect,
• request.

8.4. The Seller will respond within 14 days.

9. Intellectual Property
9.1. All content, designs, and products are the property of GEMSTONIKA, unless stated otherwise.
9.2. Any use without permission is prohibited.

10. Personal Data
10.1. The administrator of personal data is the Seller.
10.2. Personal data is processed for the purpose of order fulfillment, based on:

• Article 6(1)(b) GDPR (contract),
• Article 6(1)(c) GDPR (legal obligation),
• Article 6(1)(f) GDPR (legitimate interest).

11. Consumer Rights (B2B with consumer rights)
11.1. Natural persons conducting business activity may have consumer rights in certain cases, in accordance with applicable law.
